Unlike the others types of work visa, the general work visa requires that the employer has made every attempt to try to fill their vacant position with either a South African Citizen or permanent resident. Can spouses and partners of general work visa holders also work? Only the holder of a general work visa is entitled to work. An accompanying partner or spouse visa can be applied for but this only allows for entry and stay in South Africa. Should the spouse or partner also wish to take up employment they would need to apply for the appropriate work visa themselves. Also children would need to have separate applications made for study visa.
How long does the application process take? Time frames for processing general work visa vary greatly. Once the application has been submitted it generally takes around 8 – 12 weeks but delays in this are common. Please note that compiling the application also takes some time as adverts must be run and SAQA obtained.
How long is a general work visa valid for? The validity period can vary but is typically between 2 and 4 years. General work visa can also be extended by a making a further application towards the existing general work visa expiry date.
Can I apply for permanent residency with a general work visa? The first step is to secure temporary residency and you cannot apply straight away for permanent residency. However, once you have held your general work visa for a unbroken period of 5 years you may apply for permanent residency.
What comes first the job offer or the work visa? Prospective immigrants to South Africa are often frustrated as they attempt to secure jobs. An application for a Critical Skills Work Visa has to be accompanied by proof that the applicant falls within the critical skills category in the form of:

A confirmation, in writing, from the professional body, council or board recognized by the South African Qualifications Association (SAQA), in terms of Section 13(1)(i) of the National Qualifications Framework Act, or any relevant government department confirming the skills or qualifications of the applicant and appropriate post qualification experience.

If required by law, proof of application for a certificate of registration with the professional body, council or board recognized by SAQA in terms of Section 13(1)(i) of the National Qualifications Framework Act.

Proof of evaluation of the foreign qualification by SAQA and translated by a sworn translator into one of the official languages of the Republic.

BUSINESS VISA
This is a permit issued to foreigners who intend to establish or invest in a business in South Africa in which they may be employed.
A business visa in South Africa is designed for foreign applicants who wish to invest into:

What is the eligibility criteria?
Qualifying for a business visa can be broken down into 2 areas, the applicants themselves and their good standing and the proposed business.

there is a minimum investment into the business required of ZAR 5 million. This amount can be reduced with a waiver application for certain businesses.
Creation of jobs
the South African business visa is designed to encourage the creation of jobs and as such the business visa holder must employ 60% of its workforce from South African labour.
The success of the business
A thorough business plan is required that will demonstrate the business has every chance of success.
Appropriate company structure
business visa holders are required to have an appropriate legal structure in place.
Contribution to South Africa and good standing
when making an application for a business visa you will be required to make various registrations, these are designed to ensure compliance with tax and workers obligations that you will incur.
Desirable or undesirable

OTHER WORK VISA OPTIONS

INTRA-COMPANY TRANSFER WORK VISA -An Intra-company transfer is a type of work visa that allows for a staff member to transfer from an overseas company to a branch, subsidiary or affiliated business that is operating in South Africa.

How long is the Intra-company transfer work visa valid for? An Intra-company transfer is a temporary work visa only, and as such its validity period is for a maximum of four years. Please note an Intra-company transfer work visa cannot be extended. The Intra-company transfer work visa needs to be applied for outside of South Africa.

CORPORATE WORK VISA - This is a visa issued by the Department to a corporate worker. A corporate applicant is defined as juristic person established under the laws of the Republic of South Africa or foreign country as a corporation to employ foreigners to conduct work for such applicant.
A corporate visa can only be issued to South African registered company
or branch (the applicant) and it offers the possibility to employ great numbers
of employees from abroad, all under the remit of one application.
The Corporate Visa may be issued to a corporate applicant to enable them to employ foreigners who may take up employment for the applicant for a limited period of time.

SECTION 11(2) SHORT TERM WORK VISA - In the case of short term work or an urgent need pertaining to a limited duration (not exceeding a period of three (3) months) of work activities that cannot be met by an application for a work visa, including, but not limited, to service technicians, journalists and film crews a section 11(2) work visa may be considered.
All foreigners who intend conducting work in terms of section 11(2), must be issued with a visitor’s visa (not exceeding a period of three (3) months) at a foreign mission of the Republic of South Africa, before proceeding to the Republic.

SECTION 11(6) SPOUSAL VISA WITH WORK ENDORSEMENT - A work visa may be issued to the spouse of a South African citizen or permanent resident. This visa falls under the visitor’s visa category and allows the applicant to conduct work whilst residing with a spouse in the Republic.

Work Exchange Visa - This permit issued to applicants under the age of 25 years and may only conduct work for one year. Exchange visa may be issued to foreigners who are not older than 25 years of age and wish to participate in cultural, economic or social exchange programs administered by an organ of the State or a public higher educational institution in conjunction with an organ of a foreign state.
PERMANENT RESIDENT
In terms of granting permanent residency permits, emphasis is placed on immigrants who are in a position to make a meaningful contribution to Broadening the economic base of South Africa.
This category of permit is applicable to foreigners who have been residing in South Africa on the basis of their work permits for a minimum period of five years, their spouses and also to dependents of South African Citizens/Permanent residence permit holders.
RESIDENCY-ON-OTHER-GROUNDS PERMITS
This category of permits applies to foreigners who:
